Federal courts consolidate Amtrak 188 claims

PHILADELPHIA — A Federal court panel says more than 60 lawsuits filed over injuries and deaths in the May crash of Amtrak 188 will be heard by a single judge in Philadelphia, the Philadelphia Inquirer reports.Website Insert Development Finance and Management copy

Since the crash, rescue efforts, and track in question were all within the federal judicial district that covers Philadelphia, it made the most sense to have proceedings there, one judge wrote on behalf of the panel. The newspaper says other lawsuits have been filed in federal courts in New York, New Jersey, Maryland, and Washington, D.C.

Other reasons for consolidating administration of the cases include a Congressionally approved $200 million liability cap for Amtrak in incidents like this and because the national passenger railroad has already admitted fault, minimizing the time courts would take hearing cases.
